Article I – Subject, Price, and Payment Terms

1. Subject of the Contract: These GTC govern the sale of guided tour services offered by EI JOFFRAUD YANN (the Operator) via his website www.strasbourgtours.fr to the Customer.

2. Price and Payment: Prices are indicated in Euros (€) and are understood to be Taxes Included (TTC), at the VAT rate applicable in France. Full payment for the service is required and must be made at the time of booking via the Operator's secure payment platform (Bokun/Adyen).

Article II – Privacy Policy (GDPR Compliance)

Personal data is collected and processed in accordance with the General Data Protection Regulation (GDPR). The information gathered is strictly necessary for the execution of the service:

• Data Collected: Name, First Name, and Contact Details (email, phone) for validation and urgent communication.
• Purpose: Inventory management, execution of the reserved service, and invoice dispatch.
• Refund Data (Optional): Data necessary for refund purposes (if the option is chosen by the Customer) is transmitted to Protect Group for the administration of the insurance under the Enhanced Refund Terms.

Article III – Cancellation and Refund Conditions

Cancellation fees are applied according to the policy selected by the Customer during booking:

1. Standard Policy (24-Hour Rule):

• A full refund is granted only if cancellation is made more than 24 hours before the Tour's scheduled start time.
• A 100% fee is applied for any cancellation made 24 hours or less before departure, or in the case of a "No-show."

2. Enhanced Refund Option (Insurance):

• If the Customer opts for the insurance (if available), any refund request is handled directly by the insurer (Protect Group) and not by EI JOFFRAUD YANN. The Operator is not responsible for the outcome of this claim.

Article IV – Service Execution and Participation Conditions

1. Operator Cancellation: The Operator reserves the right to cancel and issue a full refund in case of Severe Weather Conditions (which could affect safety) or if the minimum number of Participants required for the Tour is not met.

2. Customer Delay: The Tour starts at the exact time indicated. The Operator is not required to wait for latecomers beyond 5 minutes after the scheduled departure time.

3. Minors and Dogs: Minors must be accompanied by a responsible adult. Dogs are allowed under the exclusive responsibility of their owner and must be kept on a leash.

Article V – Applicable Law and Dispute Resolution

1. Applicable Law: These GTC are governed by French law.

2. Mediation: Pursuant to the French Consumer Code, the designated mediation entity is CNPM MÉDIATION CONSOMMATION. The Customer may submit a complaint online or by mail.

Article II – Sub-processors and Data Recipients

Data is hosted and processed by the following entities as part of service execution:

• Booking Platform: Booking data is managed by Bókun (part of the Tripadvisor group), which acts as a technical sub-processor.
• Payment Platform: Transaction data (credit card information, etc.) is securely handled by the payment service provider Stripe, which acts as a Bókun sub-processor. The Operator never has access to full banking details.
• Enhanced Refund Option: For customers opting for this option, certain data (booking, name, contact) is shared with Protect Group, the provider of the refund insurance.

Article III – Data Collected and Purposes

We only collect data necessary for the execution of the Tour (legal basis: performance of contract) and for our legal obligations.

The data collected and their purposes are:

• Name, First Name, Contact Details (Email/Phone): for booking validation, urgent communication, and invoicing.
• Reservation Information: for inventory management and service execution.
• Refund Data (if option chosen): for transmission to Protect Group to administer and process a refund under the enhanced terms.

Article IV – User Rights (GDPR Compliance)

In accordance with the GDPR, you have the right to access, rectify, erase (right to be forgotten), data portability, and object to the processing of your data.

Article V – Retention Period

Booking and invoicing data are kept for the legal period required by the French tax authorities, which is generally 10 years for accounting documents and invoices.
